Yea well, i got careless and they got me. Kinda stupid now. But i gotta have to pay 915€ for "torrenting" Batman vs Superman. I got my own layer involved and i have to wait for a response from Warner Bros. lawyer firm . I am wondering though, is there any chance they will either drop the claim , or reduce the fee i have to pay ? Anyone got experience in this, will they back down when they see me lawyering up ?

Yea but unfortunalty im not getting trolled or scammed. That lawyer firm got warner, sony and several other big companies as client and they are in charge for over 75% of the copyright infringement claims in GER.

Just wonder if they gonna back down now because i did not sign the shit they send with the claim, instead my lawyer wrote his (my) own version saying i will refrain from torrenting that movie BUT plea not guilty. So lets see if they wanna push it.

It's legal, that's how the law works in the country. And you are not advised to ignore these letters.

Sometimes you can send a letter you download from the internet that stops them from pursuing the matter any further but that doesn't always work. Others pay a lawyer (hundreds of euros, but hey, better to pay 400 euros to a lawyer than a 800 euro fine, right?) to do the same procedure with the letter and hope because a legal firm will be behind it that it will work.

After you send the letter, they will probably not respond if they are not going to take you to court. If they do respond that it's unacceptable (unlikely), don't say "whatever", negotiate to lower the fine or pay it. Never ignore them!

I interpreted "getMoreMoney" as living in Germany.

In Germany the law is that the ISPs have to provide your full details if you are accused of pirating no matter how big, small, new, old, what you are downloading is.

Idk if it is how you phrased it, but that does sound like an admission of guilt to me. "I never have, never will" is different from "I will stop, but actually I never did it in the first place, really"...

Anyway, you are doing the right thing by doing your own research and not (blindly) believing your lawyer, but I'm pretty sure he knows what he is doing.

But! I might be wrong about this but bear with me. Afaik, in Germany, he might be able to avoid it because "an IP ≠ human being" which should still hold true. He should ask his lawyer about that. I might be severly outdated with that tidbit but I remember reading alot about cases like this that have been dropped due to it in the past. Also, people who had dynamic IP, also had an even easier time with avoiding it.

To me, that sounds like something that you will have to fight for in court to prove your innocence. "Your honor, that wasn't my IP address". "Objection! You honor, he is lying, take a look at exhibit A, which shows ISP's provided data, etc." Laughing Surprised

And you don't want for it to get this serious, because if you are found guilty you'll pay even more.

As I remember, the initial fine, or a large part of it, is for their "legal expenses" tracking you down. If you go to court they will also charge you for the pirated material itself. And you'll have to pay even more money to your lawyer because the case is more serious. And you'll also be quite stressed.

Will they take you to court? Maybe not. Probably not. But I believe they have taken some people. Are you willing to risk it?

The best course of action is sending them that letter that says you won't be pirating this film, while also not admitting that you ever did. It will stop them in the vast majority of cases. The question is, do you send it yourself or do you get a lawyer involved. Sending it yourself will cost you nothing, but getting a lawyer involved will put your mind more at ease..

Me, I would probably send the letter on my own.. But I'm not living in Germany, so what do I know.. I'm just saying what I've read..

Those 915 are pretty much cheap compared to what they could've sent you instead. But yeah there's no way around it other than paying and stopping torrenting altogether. IMO it's so unsafe compared to premium accounts on downloading sites. Using the latter I haven't been charged with anything for the past years. They'll always catch you on the "sharing" part.
