First 12ish minutes is about how they develop the game + other stuff like where they work etc. Gameplay beyond the 15:30 mark(first few minutes are from a really early build, 22 min if you don't want to see that).

Same as with stuff like Hydrophobia I think, you publish via XBL you have to agree to what Microsoft demands.

Of course but I imagine there's little these smaller studios and teams can do to change it if they want a favorable reputation and the like with say Sony or Microsoft.
(Or Steam even I'd imagine to use a PC example, haven't they rejected certain titles for various reasons?)
