If it comes on CD - why not? It can have copy protection
If you downloaded it - look for crack or registration key or something

First scan cd and install dir(if you already installed it) to make sure you know the copy protection.
Assuming it is Safedisc, you need to download Alcohol 120%(trial or full Twisted Evil).
Once installed, press the "Copy wizard" button. Now you just need to fill in the Datatype of the cd (here it's either Safedisc or Safedisc 2/3) and lower read speed to be sure it copies the disc successful.
Now Press next until you can change burn settings. Lower Write Speed and if you want select the "Delete Image file after burning" option if you are not planning on copying it multiple times. Good luck.

P.S. Cloning a safedisc protected disc with success is a hardware dependant thing. If it doesn't work with one drive, try another one.

it might give an error and just work fine.

just check 'continue after write error' in nero.
Or maybe make a nero image first, else you might waste 10 cds

How old is this program?

If it's old there are programs to completely remove the protection from the EXE, especially if the EXE is encrypted inside of ICD file (2000, can't remember SafeDisc version, maybe 2.3ish?).
