Suppose I downloaded this game for free and I have an illegal serial with which I am playing the game and my character is already level 40, suppose I now decide I really like the game and I'd like to support the gamemaker and I buy the game, will I be able to continue with my old character on my legal game?

I believe someone said somewhere in one of it's threads that your save games are bound to your savegames but can be edited with a hex editor. |

Savegames are tied to the serial used. No idea if that can be fixed or not though.

try "Soulseekkor's TQ Defiler"
dunno which version you are running but prior to the TQ1.30/IT 1.10 compatible versions it had a "change characters CDKey" option.
the current version has "only" change TQ Key / change IT Key.
but i suppose with the "Patch me" feature (which makes TQ say ok to changed savegames due to mods or due to the TQ-famous storage tool "TQVault") would do the job even on 1.30. on IT it may not even be needed to do more than change the key itself, but i dunno.
if youre going to buy it anyway i may just recommand to get a "Gold" or whatever version which includes the Immortal Throne addon , install IT with valid legit serial and then simply use the import function to import your TQ Chars over to IT. the IT import function doesnt care about the TQ key afaik and since your IT has a legit serial then .... tada
