When I was banned from XBOX Live about 4 or so months ago I tried to cancel my account from my profile on the XBOX website.
However even though it appeared to have the option, the link didn't work so what I did was edit my credit card details and change them to just a blank entry so that they couldn't charge me for it.
This month MS have charged my account using details for a now out of date credit card using historical details from their system?
And when I spoke to customer support this is apparently completely legal, even though to my knowledge by removing my credit card details, I was removing their right to charge me?
Any legal students here?

it shouldnt be allowed but if you ring your credit card company or bank and state this payment was unauthorised then they will investigate it and you should recover the money ..
be sure to mention that you deleted your c.c details from the site ages ago and see if they say its legal storing financial info - check m/s t/c's as well as it may be stated

Check the user agreement for Xbox live, it's perfectly legal for them to do that considering you were banned.
What you need to do is cancel any further payments to Microsoft through your credit card provider, it's highly unlikely you'll get your money back.

Wether I was banned or not is irrelevent. The billing section just says that I have the right to change my payment method; which I did, and they have the right to end the contract.

You need to cancel your gold subscription by phone, there is no other way. This is common knowledge, or so I thought.

That's not the issue.
My problem is that I followed a link from xbox.com to billing.microsoft.com which required me to login; and contained my credit card details.
The issue is wether MS has the right to reuse credit card details once i've removed them from their system. By my reckoning they should only be legally entitled to stop my subscription; not re enter my card details.

Depends what contract, if its month to month contract then they have no right to charge you if you inform them you no longer want to pay for it. They can use historical card details to charge you if havent cancelled it and put in details that they cannot get payment for, however they shouldnt be able to use an out of date credit/debit card as this should no longer work anyway!

Well, in my case, i bought a three month subscription in May, wich is also the same month i was banned. And yet in august they charged the amount for yet another month.. wich is pretty weird.

The card wasn't a specific credit card, it was a debit card linked to a current account but it was a Visa transaction so I don't think there is a difference legally.
I've looked at the billing website and there doesn't appear to be a mechanism for changing the actual number; just the name, address and expiry and start dates.
I can't remember wether the website functionality has changed; but I distinctly remember being satisfied that there was no longer sufficient information to perform another transaction otherwise I would have had to call them directly; not wanting to because it was the first wave of bannings so I wasn't sure if any further action was going to be taken, and as time passed I just forgot.
To be fair I'm prepared to accept that I'm wrong, just not by a patronising guy on the helpdesk so I rang them back and just asked for the issue to be progressed to a member of their legal department to call me and explain properly.
It's just £5 tbh and it's not like they're intentionally trying to con me but the principle caused me to give them a call.

this is so funny u screw ms for so much money in pirated software and everyone says screw M$ blah blah they charge u a couple of dollars and u r crying like a penniless begger, i have a saying live by the sword and die by the sword ie u screw them, they screw u , get over it. But thanks for making me laugh.
As for framerate, the 360 version runs smooth, while the PS3 is a jaggy mess that chugs along in slow motion.
