MS isn't scanning for game data yet but it would be an easy and foolproof way to find pirates and spare those who make their own backups.
Let me elaborate:
some scene releases have game data that is different from what you'll get from a retail disk. Probably due to ripping mistakes. If MS gets their hand on the scene releases they can compare to the corresponding retail disks (same XBE, same SS).
If they check for the scene release's characteristics that would allow them to ban only those who download games, not those who copy their own games ("legit backups").
But even without that scenario, shouldn't we try to get 100% proper backups to ensure a ban-safe future on Live? If you agree, read my post in the other thread.

if you have been playing these old backups even now, dont you think they deserve to be bought? After all u can get Saints Row for less than 20 bucks now.

I bought PES6 and I have never played Saints Row in my life. I'm just saying that if the scene cares about quality it should re-release rips with improper game data.

nothing useless about iXtreme, all current new releases are iXtrme compatible and if older release are not then they simply won't boot

Its only a small amount of games. Just like a small amount don't have stealth patches or correct video partitions,

of course it is, they ban your whole console not just drive
in fact i'm pretty sure this fw does nothing to protect u from ban as any previous fw's did, same goes for so called stealth patches
