I don't believe it for a second. The only way these people are getting banned is because they are playing games before they are released and getting achievements.

Bullshit. If a retailer breaks the street date and you buy the game before launch you're not breaking any law or TOS. MS can't ban you because of that.

I havent been banned yet... but i don't pay for it at all and I have never played multiplayer with any games. the only thing i can think of thta I used to connect to Live through a game was Guitar Hero II to get high scores and leaderboard... but I paid for that game... so if they are checking disks somehow, it wouldnt have mattered.
I connected to Live yesterday for the first time in ages to see if there was an update for Rock Band, but I bought that game too.

It appears that modified fw is NOT being detected, and is instead once again due to 'bad' discs. Keep in mind that the only full proof way to make a 1:1 backup is to do it yourself. iXtreme is as fullproof as it can be, in that it validates everything it possibly can from a firmware point of view, but a game can have slight data change somewhere, most commonly in DMI. Or it can be due to early copies being watermarked so to speak.
This is why you run the risk of being banned on xbox live if you pirate games. Always remember that you run a risk doing such actions.
In regards to game data being properly validated, xdvdmulleter is a tool that has a constantly maintained database to validate backups against retail copies to ensure full stealth. I played COD4 alot on live and no issues....
The only game I found so far with mulleter being totaly f'd is Guitar hero 3

I aint banned yet, once i sign into xbl I unplug my lan cable before playing a backup to sync the time/date, though on a few occassions I have not disconnected when playing Mass Effect, Assassins Creed.
