Anyways, I modified the ISO, so I've been playing this all day.
It's not a bad game, 7/10 for me. It would be higher, because it is a bit original, but it's also quite buggy and feels a bit unfinished. The tutorial is also not very good, I'm still not sure how the abilities and everything works.

As for framerate, the 360 version runs smooth, while the PS3 is a jaggy mess that chugs along in slow motion.

There are typically two kinds of game that don't have a demo, the blockbusters that everyone will buy regardless, and those games which have something to hide.
A shame I had to explain that to you, I would have thought it was obvious what type of game I was referring to.

or...a more feasible reason could be timescales of release. Demo's take time to build. Complexity of condensing tutorials into a demo and making it workable, making a demo flow as generalyl they're a snapshot of a game.

Demo's take no time to build at all, even for open world games all you need to do is add a time limit, like the original Saints Row demo. The small amount of time it takes to create a demo will be completely offset by the increased sales if the game is good.
Besides if you read my post you'd notice I was only making an observation about games which don't have a demo. A different process applies to those games that do.
This is a trend not a rule.

Another possible problem with open-world demos is, they need to pack a lot of data, depends on the area available in the demo of course, but having 2.5-4 GB demo that is limited to 1-2 hours of play sound ridiculous to me. Also, I think XboxLive has a maximum limit for files that can be uploaded (this is one of the reasons the 360 version of UT3 did not get the Titan patch/expansion).
Also saying that making a demo takes no time is completely inaccurate, especially at the age when Microsoft and Sony require rigorous testing on anything released on their download services. [I'll be talking about releasing a demo before the game goes gold, as usually happens.] Taking a snapshot of an unfinished code, slapping extra limitations on it (e.g. removing content, creating a special demo level, etc) and expecting to perform sufficiently well for it to pass QA testing, then if there are problems, having to take another snapshot of newer version of the code and going through the whole process over and over, all that takes its toll, especially on smaller development teams. Gone are the days where you have a Q3A open beta, Q3A beta demo, Q3A demo 1.66, Q3A demo 1.99. Now it's all "The demo locked up my 360, I ain't buyin` that shit" and releasing a subpar demo (if it manages to slip the QA team) is a risk by itself as much as potentially a gain. Not to sound too dramatic, but it's problematic.
Now, having written all that TL;DR, having a big developer, or most importantly, a big publisher, who can even outsource the development of the demo to another development team, having them not release a demo is like you said, either laziness due to "Doesn't matter, everyone will buy it" or "Oh shit, we better not release it because nobody will buy it!"

Apparently you can, i still get the dirty disk error when i patch then try to play...anyone know how to fix this apart from updating the firmware?

That means something is def wrong in your patching process, I had the same issues till I started using the ppf patch method instead.
Not only don't I get dirty disk error any longer but the games installs to hdd fine now.
