nope they do not get away with anything. maybe in the us, but in germany for example the eula only applies when its part of the buying contract. its futile if its only in a booklet, while any installation or changed afterwards

always hated eula's...
they fill them with so much bullshit thats written in such a roundabout way... not only is it a massive wall of text that noone who isnt involved in law would want to read, its often written in such a way that many people wont even understand what is being said IF they actually read it.
sucks that there arent rules as to what you can put into them and how you call attention to them, ill always debate their legality (or rather, their right to be legal)...

Not true. The companies to write stuff in their EULA's, but that's doesn't mean it's legal. In many countries, Germany especially, it's not even entirely certain if these EULA's are valid, because you would have to be able to read them before you make the contract, in this case buy the console. But because you have to agree afterwards, it might be nonvalid. But then again someone would have to sue Sony, and I don't think that's happening...

Yup, looks like it. Here's TOS from 2008 (Version 4.1 (15 October 2008):
http://www.scei.co.jp/ps3-eula/psn/e/e_tosua_en.html and 9. chapter has pretty much the same content as the "new one".

Well imagine buying a car - you can throw it away or sell it. But the manufacturer can come and remove the wheels at any time.
