So why is everyone going on as if it happens today?

AFAIK it was only the White House that said they will not sign this into law. Which of course means jack shit, as it was revealed at new years eve when they signed that military detention act despite saying they will veto it. So this is very much on the table still.

It's just a cover anyway. They'll expect it to be shot down and instead they'll propose something far less excessive which won't get as much, or any, attention. Then they'll do it again and again until they have all they wanted and more. Piecemeal is the oldest trick in the book.
