What about EA and the rights to the franchise?
(Then again I guess they could change the name and a few smaller things to try and avoid such issues.)

No need to "change" the name, because as far as I can see they haven't named it (nor could they as you've pointed out) Syndicate in the first place.

What the hell has taken them so long (any game developer)? There must be a billion people who wants a game just like it (or very similar, i don't care if it's called Syndicate or whatever). Would back in my sleep without looking..

Perhaps with stuff like Torment and some other successful Kickstarter campaign results they now believe it's possible to get the funds needed via crowdfunding to succeed with this project?
(That or there were some legal issues to clear up first.)

The only issue Kickstarter has so far is developers (or inventors) overstating their capabilities and making grand promises they can't fulfil. As a funding model itself, I don't think there's anything inherently wrong with Kickstarter and it has borne some great successes so far.
