I know it was today, which is what surprised me after MS had said - only a week ago - that they wouldn't be banning. However, the whole "illegitimate" part is right. Sorry, hadn't seen that >_<

I wonder what parameters he's using to find the legal players, etc. Hopefully it's not region-specific (ie; people in the UK are playing the French copy) as that would just be cruel. I'm thinking more along the lines of the people are used the hack-extract to get around the missing RAR file, while still being able to burn the disk --- that, at least, would fail security checking and show up on any scanners MS have.

i think it's rather simple: MS checks who plays ODST, out of that list they check who has a firmware mod. banhammer slams down.
of course playing with a bad image and/or not residing in france may rise additional red flags, but the method above is foolproof anyway.

Umm, how is it foolproof? If it was foolproof and that MS could detect FW mods ... then surely EVERY single person who has flashed their drive would be insta-banned, or at least they wouldn't escape the November banwave.

I think if it was that easy to detect, there would be nobody left on Live, if they had a firmware mod.

it has been proven that MS can detect firmware mods, since even ppl who had an (up-to-date) ixtreme fw, but didn't play any verbs on them have been banned.

and just because they can detect you, doesn't mean they have to ban you. first of all, they would be diminishing their revenue from xbox live by simply banning everyone with a fw mod. secondly, it adds to the mystery of the banhammer.

it's the same with piracy in general: of course entertainment companies could go after every individual and punish them as they desire - but aside from the effort that would be needed, it's more effective overall to just scare potential customers away from piracy by metaphorically assraping a few, rather than punish al of them.

Wouldn't it just be banning your account from Live, you should still be able to log in offline right?

So at least you'll still have access to your DLC and save games etc.

true, but if you think about the RROD possibility, your DLC will be in danger sooner or later since you have to re-activate it when switching consoles. not to mention if you have a LIVE gold subscription or MS points on your account, the cash is gone. plus there are enough ppl out there who would cry about their suddenly cut off gamerscore penis. Laughing

i'm just happy i tried it out with my worthless second account. phew, dodged a bullet there (couldn't care less about my console getting banned, besides it would be a miracle if it doesn't die till the next banwave).

Good point, I hadn't thought of the offline account. I've been so caught up in the whole XBL thing, that I don't even think about "offline accounts" anymore ... >_<

and then connect to live and not playing this game at all,
they still can Ban you?
