No, no one has a working copy of the game. There is no release out there yet, only the Xbox 360 version is out on the net.

It'll be exploited in seconds. Borderlands doesn't have activation limits so all you need is a 1:1 disc image and you're set. I imagine they'd catch on to one key being used too many times rather quickly however.
Anyway.
Retail: SecuRom CD check + Unique serial used for whatever + Online activation (using that key).
Steam: Steam + Unique serial above is used for MP maybe?
/shrug. I'll be playing on LAN anyway.

Always funny to see e-lawyers talk about lawsuits and other inane nonsense. Equally funny to see people blame Gearbox for something that is 100% entirely the retailers fault.
Here's a solution. Don't ship games to stores early to have on the shelves first thing release day. Ship them at launch so you can wait several days for them to get them. Betcha'd love that!
The game doesn't release until it releases, for whatever reason. That is not Gearbox's or 2k's fault. Blame the store who sold it early. Get over it.

Or just learn2logistics like everyone else, though my guess is they just shipped it together with console versions to save, but it's entirely within the realm of possibility to have the copies arrive at the retailer the day before release, and logistics is also the publishers responsibility, so if they would, they could.

It'd be fine if that release was at the same time as the console version but that's not what happened now is it? It should be of no surprise to you that people are angry about the delay and the fact that retailers (pretty much everywhere) have copies only makes the situation more annoying.
I'm sure even with shipping worldwide they could have the release date a lot earlier than the 26th.

I agree. But imagine the peeps that dont go to forums and stuff and just pick it up on a whim only to get home and fine it wont install.
I can understand the frustration. And it makes me sad for a really good game developer to have a really good game that might be tarnished on the PC because of this release fiasco.

They don't ship one game at a time, the distributors ship many games at once. Also other things, controllers, hardware, etc. The stores place orders and the distributors they get everything from handle that. 2k doesn't send the boxes directly to the stores.
It's not hard for a store to see 'don't sell until date X' and not fucking sell it, yet they still manage to fuck up on a colossal scale.

I'm sure it is frustating, but a rational consumer would say 'well, the store fucked up. Maybe I should do business elsewhere. Either way I can't blame the developer for something they didn't do!'

There is meant to be some form of punishment for a store breaking a street date but it never happens. No risk of punishment means everyone will do it.

I'd like to know what crazy world you live in because the majority of consumers are going to be the irrational ones. You buy something you expect it to work. Bah why do you even bother bringing this up?

The punishment should be to not send that store any more new releases, but that would kill the developers as they need their games out there as much as possible. So Gearbox/2K are the ones being fucked over. They get bad publicity for something they didn't do and yet they have to take it if they want big chain stores to keep ordering their shit.

If it was that big of a deal 2K could easily remedy the situation but clearly they don't think it is or simply don't care. They rightfully deserve any bad publicity they get anyway. Street dates are fine but making your product completely unusable until some random date knowing your product is being sold to consumers is just stupid.

Except it's not a random date. It's the release date.
How would it be fair to other retailers who don't get the product in early? Or distributors who honor the street date?
If you let one company get away with it then people flock to them and the others stop stocking your shit.
Release dates aren't made to piss people off, they are there to give an equal and fair opportunity for everyone to both sell AND buy the product at the same time.

Now you're just arguing for the sake of arguing. The release date for PC Borderlands was not set so they could make sure every retailer got the game and was set entirely for other reasons. You know this. Now retailers are leaking the game early and 2K has the option to remove the restriction and turn on their activation servers but they don't.

Oh I think in this case it is designed to piss people off. Piss them off enough to make them want to buy the available console version. We could continue arguing about pointless things all night we really could but that doesn't interest me.
