Your profile will not indicate whether or not your console has been banned. The only way to find out is to try to connect to XBL.
I just tried and I am not banned. I'm in the Netherlands BTW.

There should be some way to find out if console is banned without losing install feature, what about testing live connection with hdd removed?

Ive been banned a looong time with my old hitachi, and have a liteon unflashed and just swap the hardrive over between them. This way i get the newest live updates on my old machine, and it still installs games just fine. Is this just something in newer bans then? a new type of ban that actually makes your machine play everything from DVD, get to hot and die so you can buy a new one. clever.

Not sure if anyone has tried that, but if you only have an HD you need it to load your profile for live, so you cant just remove it to try live. Unless you use a memory stick with your profile on it.
Honestly, I think they remove the HD feature through the console, it has nothing to do with the HD. I could be wrong though.
Only one way to find out, and thats by someone getting banned without the HD on, using memory to load the profile rather then the HD. Its the only real way to tell if that works.

No, you don't need any profile to connect to live, there's a Live connection test in network settings, and if you are banned you get a weird error with numbers when performing a test.

So, the microsoft fuckers give money back for consoles they have damaged? If I bought a HD and these assholes damage it I'm gonna sue the fuckers and I am sure I will win, because I live in Europe and not in fucked up USA.

They don't damage the HDD. It will still work on an unbanned console.
EDIT: I just checked again. Still not banned. This 360 is fucked anyway and freezes as soon as you load a game now so I wouldn't be bothered anyway. I've got a new elite that I'm playing on that's been kept offline and will stay offline until it all dies down.

I bought a new Elite not even 2 weeks ago. Manufactured SEP 2009 and the drive inside was a JULY manufactured 83850 flashable. It's just the luck of the draw.
Other people who bought the same ELite Pure + Lego Batman report a unflashable 83850 and yesterday I read on xbox scene some others reporting the new 9 series drive in the same pack. It's a lottery.

Yeah well i'm not to fond about getting a console and then realise its a unmoddable lite-on, i found a ebay seller who sells from a wholesale quantity a Halo 3 Limited Edition Console (console only) for 151 euro with shipping included, i think i get that even its very pricy atleast i know i get a benq or a moddable lite-on.
I cant find any 2nd hand ones for a good price.

Why don't you just go to media markt. They take anything back. If it's unflashable, just return it.

At the Media Markt by the arena you can take anything back. When they open the box they just take a look inside but don't really check it. I've returned a Wii there, and the two 7 series liteon xbox 360's when they were unflashable. Both of those had the seals completely broken. They don't check for that even.

apparently if you register your device and check it via xbox.com's "register & repair devices" you can get a heads up on being banned , If it allows it to register and it's still in warranty your "safe" for the time being .
Registered there , saw it was still in warrenty and logged into live with the xbox and it wasn't banned luckily , so touch wood . Can't confirm it's correct but might give some solace to folk who are worried about losing their hdd's ability

well i never leave my xbox connected to the net.
i played MW2 and GTA:E and when i connected my xbox online today just to check.
i was banned, non of those games were inserted.
so somehow they can see you played one of the games, because i was not banned yet before playing any of them.
It's not that i care, but it does mean they can see it somehow

Achievements maybe? Your 360 also knows which games it's last played. They are displayed on the NXE regardless of whether your connected to the net or not, and regardless of whether or not you have any achievements for said games.
Maybe I'm mis-understanding your post, but I can't see how you could think that it's relevent that neither of the discs were in the tray when you connected to LIVE after playing them earlier in the day.
