But if you are banned already then you'll still probbably lose the HDD install feature after the next update. My launch 360 hadn't been connected to LIVE for 3 years as it was caught in the first ban wave but I lost the HDD install feature 2 weeks ago when I updated the dash on it when I plugged my HDD in from my new 360. If you're console is revoked then they'll get you in the end anyway as some games will not run unless you intall updates which will come on future game discs.
You don't have to connect to Live to update the system. The update doesn't ban you as far as i know, MS bans you via Live

Keep on telling yourself that if it makes you feel better, but I wouldn't be so sure. The fact is that you could already be banned and your console added to the revoked list. And if that is the case (which it may not be, you might not be banned at all) then your revoked console will likely lose it's HDD install feature after an update in the future. You do not need to be connected to LIVE for them to send some sort of command to the console in order for them to achieve this. Think about it.

Well, fortunately they don't do it like that yet, and probably they never will, so i am not going to panic about something like that right now. Time will tell.
About update, maybe it's not the latest, cause i don't use Live to update so i don't know for sure. One of the latest anyway.

Untrue: if you're banned it's not because you connected in the past two weeks, it's because it is flagged for banning. If you're flagged for a bann, it doesn't matter of you log-in now or in like 10 weeks. You'll still be banned.

just update... Wave 4 will work with 1.61 and that's what you're after.
This is what my wife told me the guy said. It just fits a bit too perfect for him to make this up, considering the ban wave now as well. Neither did he have any reason to make it up. Obviously he knew I have a flashed box and gave some advice.

I would patch games if i were you. Takes 10 secs to patch so why bother to flash something, it will probably only work until next wave anyway

Patching games doesnt seem to work for me, that is why I want to update..unless some new firmware comes out that removes bans that have already happened, mind as well update. I really want to play these wave 4 games plus the wave 3 games I already own

Maybe it's a good idea to flash to an old Xtreme 5.x fw.... It boots everything so all waves and all future waves and even bad rips are automatically supported
Is there any truth to Microsoft testing your 360 the next time you come on live to see if you have a modified firmware, and if you don't unflag you?

Possibly. Some guys over at xbox-scene claims this works. I think 2 or 3 different users confirmed it.
I think it might be possible. Maybe the detection process is not 100% accurate, therefore needing multiple erroneous responses from the console to ban it permanently. If the console all of a sudden responds well the ban is waived. This is all speculation (as everything with the bans unfort.)

Yeah there is a way without using your console from what I read. Log in to the US service site http://support.xbox.com/support/en/us/nxe/registerdevice.aspx?step=repair (request went through on the European site for me) and request a repair on your console. This is the screen you do not want to see (took the screen myself when I wanted to check if I was banned).

Now I am just hoping future updates on game discs will not render my HDD useless. We'll just have to see. I am never connecting to live again though.
They have a database of keys on their end, on their servers, all they do is delete your key from the database.
Once your Xbox tries to connect and their server says your key is gone, boom, you're done.

But it's not like their db is waiting for you to log in to catch you, it's already done whether you log in or not.. it's just whether or not your console knows about it.
I mean, it's sort of flagging, but not really. They don't have to do anything beyond deleting your key.
