You can jailbreak every iDevice, but the with latest ones you can´t restart the device.
Everytime you restart the device you have to jailbreak again!

dont buy 32gb version because you can not even downgrade a firmware only the 8gb version i think
I suggest you head over to ipodtouchfans forums...probably none of the teams will release a jailbreak for 3.1.3 because they all waiting for newest ipad/ipod 4g? or probably newest device with firmware 4.0

Nope, not firmware related, but bootrom related.
