Things like 720P caps of primetime shows on FOX, ABC, NBC, CBS? Since these shows are available for free over-the-air, especially in HD, I suppose its reasonable to say that it is legal to capture and distribute them -- or is it? Also, if they are distributed over channels that are otherwise 100% known for illegal content, and are also not available anywhere else ("scene release"), does that change the circumstance? Just curious...

Well, it's more of a hair-splitting self-question regarding "guilt by association" -- using distribution method that is 100% known for illegal activity, yet the content itself is not (say for instance, torrents and private trackers) -- does that change the circumstance of legality? I'll read over those links for sure.
Edit: Wisegeek article was to-the-point. So it still would be considered unlawful, so to speak, because of potential distribution value of international sales/viewership. Also, interesting to note that "fair use" does not include (mass) redistribution :\ So it would violate copyright act on that statute alone, so it seems...

Dude, they paid to produce their shows and they are the ones and only ones showing them. Unless permission is granted, they can't be reproduced.
