Uhh they check the xbe to see whether it is signed or not. Retail copies are signed. I also presume they'll check for watermarks and they found one here.
If it's not signed and has watermarks then it's obviously a beta.

It is signed, but a watermark is probably the problem.

Ok I have never actually done anything like this before but I think I will have a go modifying the DVD9 so it will fit DVD5. I have Radtools for downsampling bik video and some basic information on how to use it but after looking through the files contained in the DVD9 image there appears to be two folders that are pretty much identical. One is Videos and contains 50 bik movies and the other is VideosPal which is a fraction larger but contains the exact same files. Since I have a PAL Xbox, could I delete the Videos folder which cuts down the DVD9 instantly by almost 1GB and then downsample some videos until I get DVD5? Is the game still likely to work with a missing or empty folder? Anyone know?

I got the DVD9, unpacked the rars, extracted the ISO and copied the contents to my hard drive but all attempts to run result in the Evox loading screen followed by dumped to the dashboard a short time after. It could be because I have been messing with the settings to get Super Monkey Ball to work but I have disabled all the IGRs, set video mode back to PAL and it still won't start. Anyone else have the DVD9 running from their hard drive?
May the NFOrce be with you always.

Try and remove any unwanted files but mainly by downsampling video and audio.

Thanks for your reply Nailbiter but are you playing the DVD9 release from your hard drive or is it the DVD5 version?

ive been playing the dvd5 since yesterday and honestly there's probabaly no dofference between this and the retail. No crashes or anything like that, no glitches it loads fine, the gfx look like prolly the best ive ever seen on xbox, no wait ARE the best ive ever seen. If this is a review copy is reasonable to conclude it is pretty much the final code that was given out whilst it went thru the QA phase. imho there's nothing wrong with playing the beta the chances that anything significant between this and the retail have changed is very very slim.
It seems splinter cell 4 is slated for later this year..one thing i wish ubersoft would implement is that the NPC's can notice your shadow when u creep up on them that would totally enhance the realism of how you take a guy out. I have this preodred so my lil beta test is welcomed...also the thing i love about this game is FINALLY!! u have a rating system at the end of the levels which tells you how well you did, no more checkpoint saves u can save anywhere. they really really thought about replayability with this game its feels alot more open ended the levels dont follow a path anymore you seem to have alot more freedom in how you move thru the level.
i rate my games on worth buying or not...and this gets the worth buying gold star from me

I kept playing for three hours last night, watermarks or other flaws yet to be found (if there are any at all). This game feels pretty much finished to me. And yes, it's signed.

why are you guys LOOKING for watermarks when playing the game
the watermark is in the xbe file... as in code contained in the file to show the source of the leak... so stop looking for a magical watermark to come up on the screen so u can go OMGZORZ!!! WATERMARK!!!!
:/
