Hotz has engaged in a campaign to thwart jurisdictional discovery at every turn –regardless of whether the Court has ordered such discovery or not. Most seriously, after Magistrate Judge Spero ordered an inspection of Hotz’s devices and ordered Hotz to appear at a deposition in California, SCEA learned that Hotz had deliberately removed integral components of his impounded hard drives prior to delivering them to a third party neutral and that Hotz is now in South America, an excuse for why he will not immediately provide the components of his hard drives as requested by the neutral. Hotz’s attempts to dodge this Court’s authority raise very serious questions.

The hacker also lied about having a PSN account:

On January 12, 2011, Hotz submitted a declaration to the Court (Docket No. 19-1) in which he made unequivocal statements on a number of topics. However, when it came to discussing the PSN account, Hotz equivocated, stating: “To the best of my knowledge and belief, I do not have a PlayStation Network account.” Hotz also provided interrogatory responses that he has refused to verify, stating that he has not accessed the PSN. Bricker Decl. ¶4.Hotz identified four PS3 Systems in his possession. Bricker Decl., ¶4, Exh. C. He explained that he had purchased one of these consoles new in February 2010 and provided the serial number for that console. Id. SCEA used that serial number to determine that on February 25, 2010, Hotz purchased the PS3 System at a Gamestop store just miles from his home. Law Decl., ¶6; Bricker Decl., ¶6, Exh. E. SCEA’s records show that the same PS3 System was used on March 10, 2010 to create a PSN account under the user name “blickmanic.” Law Decl., ¶6, Exh. A. The IP address associated with the registration is located in Glen Rock, New Jersey, where Hotz lives.

Then, more evidence regarding his PSN account was discovered:

Hotz’s ownership of the “blickmanic” account is further supported by the fact that an Internet search of the user name “blickmanic” reveals a posting discussing the jailbreaking of cellular phones – Hotz’s original “claim to fame.” Bricker Decl., ¶7, Exh. F (“Just curious what people would pay for exclusive rights to this solution. [Motorola] Tracfone W175g unlocked and debranded. PM me.”) As discussed above, to create his PSN account, Hotz was required to first agree to the terms of the PSN User Agreement and thus he is clearly subject to personal jurisdiction in California. It is well established that a valid and enforceable forum selection clause operates as consent to personal jurisdiction in a designated forum.

Sony continued that even without his PSN account breach evidence, they already have enough evidence against him:

Although Hotz’s PSN account registration clearly establishes jurisdiction, even without it, SCEA has shown the necessary minimum contacts between Hotz and California.

That's rather poor journalism. "Ran away" is a value judgement. They don't know whether he had plans to travel or not, and in any case, I'm not aware of anything in this case preventing him from leaving the country. If he wishes to take a vacation, why shouldn't he?

I believe it's nonsense anyhow. I DO believe he always had a PSN account, or at least had one at one point, but running away? Nah, I don't believe that - and won't until hard evidence is provided. Now, the HDD sabotage? That's not out of the realms of possibility :\

he asked the net for donations for his legal team. as far as i know, he achieved the sum he asked. if you think this, and him running to south america... it'd make sense. he had the money to do so Razz

hope it was worth it, hotz. i would much rather be a popular grouping of letters that forms a name i like versus having my whole life played out in front of the world. besides, someone as smart as him, he could've easily taken credit for his work later on.

on a side note i'll bet that mathieulh provided him with the tickets, location and plan to run to south america, if true. probably even knows what he's going to do next but he most likely won't tell anyone.

Graf_Chokolo is very close to release the dual boot 3.55.This means that ps3 owners will have the option at startup to boot 3.55CFW or 3.55OFW or Linux.

Insider knowledge Wink The admins on P-Scene know the guy and have confirmed it's genuine, with all features working as advertised -- and, like I said, the developer is well known and respected for his modchip work in the past.

Great news if true..I would definitely buy it! Good thing I stayed on 3.41..my question is, since we would be able to play games on external that have 4gig files or larger, would we have to format our external drives to NTFS? Good thing I have a backup of all of my games for just a time like this..now my dongle is on hermes 4b, would I have to install something to make this work..hope not since Im a total newbie at stuff like this..awesome news hope this is true!!

As of right now, we don't know HOW it's possible to play >4GB-file games from External, just that it's a promised feature. Once the press get their test devices, or once it goes retail, we'll know more.

yeah because from what I understood the PS3 can't even read an NTFS USB drive..but I Guess still we would not be able to work a 3tb drive on the PS3 right? Because I sent the 3tb drive that I got back to the store since I was told it didnt work, would be crazy if it ended up working now with this device but I doubt it

If it is NTFS (there's homebrew now that allows NTFS reading from within an app, just not -yet- on GameOS/XMB) -- then it's a trivial task to CONVERT your drive without loss of data =)

Oh WOW so you mean I wouldn't have to format my drive back to NTFS..it would just convert it for me using that app so I wouldn't lose all of the data that I put onto it now..that is GREAT news! I guess we will find out more info as time passes by, such as if we have to install any particular software onto the ps3 for this to work..I have hermes 4b on my dongle right now so I hope that I dont have to change anything in order for this to work

A simple Windows command can convert FAT32 to NTFS and 99.999999999999999999% of the time it's completely hassle-free with no loss of data.

LOL WOW your right, it is that simple!! But I will keep a backup of everything I Have just in case, knowing my luck something will go wrong LOL..I wonder, the games that I have right now on my internal drive, could I transfer them to external? Now THAT would be cool, right now I have 266 gig free on my internal drive, more space the better..
Hopefully the software installed isnt much different then what I have right now(Hermes 4b)

About having a 3TB external drive on the PS3, that is still out of the question right..? I just went through returning one because it wasnt compatible with the PS3, Id hate to find out now it could have worked with this new device LOL

Yes, it's still out of the question. Every time I search for information, it comes back a resounding "NO!" from people who've tried it. I've not, yet, met anyone who has successfully used a 3TB External or a 2TB internal.

Ok cool so now I don't feel like an idiot for returning the 3tb drive then LOL..I wonder how easy it would be for me to take a few of my internal games and sending them over to the external drive..would they still work? Because some of these internal games were a real pain in the butt to fix..gran turismo 5, mlb the show 2011 I would love to put on internal..I am getting excited about this thing, I hope it comes out soon

Can i actually convert my NTFS drive to FAT32 by creating a partition on it , so 1 drive has FAT32 others on NTFS recommended ?
