Because starcraft 2 had everything client based where this recieves monster positions, items etc from servers.

There might eventually be server emulators for D3, but the quality of the game will be significantly lower than Blizzard's servers - bugs, only half of the stuff working as intended or even working etc. It's the same with free WoW servers. Emulating a server is much harder than just cracking an offline game.

To be honest, if there ever is a private server or emulator for Diablo 3 -- then I reckon it will be a lot easier and happen a lot quicker than the WoW one, if even just because of the world sizes and lack of complexity. D3 is going be half the size of, and contain even less content, compared to WoW. It only took a few months before server emulator software showed up for the D3 Beta, probably even less time, and while it's barely functional right now - the fact is that it IS functional.
Still... don't hold your breath guys, lol. It's going to be a while before anything resembling Blizzard-levels of playability shows up.

There won't be an scene release or something like that. Only emulated servers. D3 is like wow and everything interesting is server side.
They made some good progress on the emulator though.

I doubt that it will be ever as good as the original because of monster ai and spawning, items and so on. So no one should care.
So with only legal options the amount of sold copies will be sky high $)

actually progress is very slow (not to discredit the developers working behind mooege obviously) and considering additional monster types, loot, quests, random events, locations, skills, runes, monster types etc etc - the 'proper' emulation of d3 wont see the light of the day in a long time and when it finally does 90% of things still will be messed up.
sc2 was totally playable in offline mode and using guests profiles thus it was relatively easy to crack, anyway i dont know if you can play multiplayer in someway on pirated copy of sc2, but even if you can its pretty pointless due to the fact that whole game community plays online on original servers with leagues, divisions etc.
btw - did anyone menaged to get the hands on game soundtrack?
