I see this as no difference to Tesco's when they were selling Levi 501's from outside of Europe. The grey market has been clamped down on for years. I think any company that tries to stop this, doesn't have it's consumers interests at heart. More lightly they're thinking of lost profits.

It's for security Wink I don't want you knowing where I live or anyone else... and "tcghost," CoD UO was out of stock for the longest time, and it still is, and I offered you a full refund way back a month or so ago when you ordered but you said you would wait. So I tried my best to get a key for you and had to buy it from a friend but I never checked it first as I'm busy these days... but ya, as I said refund is coming.

If this truly was legal, then you wouldnt need to hide behind false addresses and names.

I HATE having people know where I live. Is that a crime? I doubt you would post up your address for the world to see... it's a matter of personal privacy.

I don't actually get the games myself, they do all the processing for me. And the game would be in Thai and you would either have to copy all the files off the CD's onto your HD and then tweak the install files or go into the registry depending on the game. The game manual and box would all be in Thai, and if you are installing the Thai version of BF2 for example, you can ONLY play on Thai servers. It's not CD Key bound but it is game bound so if you have a Thai version of the game it will only allow you to access Thai servers.

internal_storm, how about you show us some box shots of a few different titles? The boxes and manuals that are supposedly in Thai perhaps? Prove all the nay-sayers wrong. Smile

He said he doesn't get the games. However, equally as good and as to prove he's not pinching the codes from the shelves. How about posting an invoice for the purchases he's made?

Seeing that you're dealing with a Thai company, you'll have a Thai invoice to show them that you're not lying.

BTW I have a new supplier for BF2 so there shouldn't be anymore stock shortages anymore. This new supplier won't give me any background detail as to his operations because of importation issues but deals with EA Thai directly and can get me as many BF2 as I need in a timely fashion because of all the stock they have. EA Thai now takes a day and a half to process and deliver orders because they are running out of stock.

Maybe for him. But I think the consumers are getting a great deal. Cut price licences that can be played online. Who cares about the disks and boxes. More and more games are being sold electronically through download. Just with games like HL2, they're being charged exorbitant prices. This way you're getting the best of both worlds. A legal game at a cut price. It may be illegal to sell them, but I seriously doubt it's illegal to use them.

@[syn] one problem with the EA license..that license is region specific. If you read the license for the Thai copies they're expressly denied permission to resell the game outside of the country. This would include CD keys sold for cybercafe's, servers, lans, etc. He may have found a seller willing to sell him the items, but the sale is illegal. Reselling the item is still illegal.
In canada I can find an american seller willing to sell me a Mace and ship it to me. Doesn't mean I can legally own it in Canada (I know, I've spent a long time on the phone with customs trying to figure out WHY). In that case the sale itself is legal. Its the import of the item. In the case of these keys they've already been exported illegaly and he turns around and sells them in a region he's not permitted to sell them in.

This is the type of thing that could last for sometime if he doesn't get big enough for the companies to care. IF 20 sites pop up with his business model and someone does a news report on MSNBC about a new trend in online games, he's as good as toast.

Unless he is buying from Disti's then it wouldnt be REselling. Although for those people who know how the business works, everyone who sells a product is known as a "reseller" Razz..

Whether he got it from a distributor or anyone else, the item is still not legal for export outside of Thailand. This is not 1 copy he bought for himself while living in thailand and was still on his PC when he moved (they could technically consider that an export if they wanted).
Anyone who purchases those keys and who does not live in thailand its purchasing goods which are not permitted for sale in their region. The keys could easily be deactivated by EA, and depending where IS lives, he could face some very serious charges.
Customs is not known for their sense of humour.
I highly recommend IS go spend some time with a lawyer who deals in international law and go over the particulars. I can almost guarentee you the lawyer is going to tell him that his business model isn't legal.
He might be able to tell him who can get him and for what. IS might just have to not visit thailand for the rest of his natural existance.

Selt, crossmr. Agree'ed!

As I said before I based my opinion on the facts at hand, which up until this point showed me that what he was doing was legal. However, the screenshot provided by Selt shows that the website which we belive the keys are purchased from shows the true legality.

I hope you guys didnt think I was trying to be an ass Razz.

Either way I do feel IS was acting on a wonderful business sense, its a shame the way he is doing it was not so legal. However, its connections to piracy are in my eyes just as flakey. There was a guy in my college back in the day (a good few years ago now) who would sell things he bought from Amazon, sure he was making money out of people with very little work, but he was simply exploiting peoples lack of experience.. It happens a lot in life, the legality of it is very sketchy, but its a rare occasion when the person in question gets damaged from it.

Ah well, we all know where to get the keys for cheap now, so the issue is solved Razz.. happy days Very Happy

Hey,

Well I'm not going to say anything there is no need to Razz But hey, I buy so much from them they gave me a reseller liscense and I am getting BF2 somewhere else now as they have refused to sell it to me because EA Thai says they are being sold all over the internet. But if somebody tries to buy BF2 there let me know how it works out, because I want to know if they actually will send it or not or if I'm the one they won't because of my large orders Razz EA Thai has only about 700 in stock at this moment in time of BF2! That is it... no more. Legal games are very low profile in Thailand, and when large purchases are being made they know it's being exported. They used to have the game in English and the manual/box in Thai, but they changed that already to Thai version game unlike the other game distributors.

I get about... 3 games from them and the rest elsewhere. The prices are too high otherwise.

You do not get a legal game. The key might be legit, but you're still using it with an illegal copy of the game.

Not really... you are paying for the entire game really, just not recieving it. However you install it is up to you. If you download the game DVD, well, that's just a backup of what you already OWN but just don't have in your immediate possesion (maybe it was lost, or in this case just not recieved).

This is true, your purchasing a lisence to use that game, that includes having a backup copy.

dear IS, u'r not the legislator and what u say is not THE LAW by default. downloading a game, wether or not u own a legit boxed copy of it, it's not legal...
the ONLY ways to use legally those keys are:

1- u lost your key but u own the original dvd/cd to install the game
2- u use your friend's original dvd/cd to install the game with your legit cdkey...

however, selling a key from a thai box to non thai customer is not legal... i wouldn't be so sure to be in the right if i was u, if someone (EA, valve, vivendi discovers the site there might be trouble... they will not just ask to shut the site down, they'll probably ask for more)

If you read the entire thread you would know that:

A) I have recieved e-mails from Epic Games Attorney
B) I have recieved e-mails from Ubisoft Legal department

and...

C) I have replied to BOTH telling them exactly where the keys were from, and have not heard back since. This was maybe a month or two ago... that is all I can say.

I am not saying I am a legislator, and I am NOT telling people to download games if that is illegal. I AM saying that I am selling legit retail CD Keys and whoever buys or in whatever means they obtain or install the game via the game's media, I am not responsible nor do I really care. Once again, I am not selling to non-Thai customers, but rather, I am selling to the entire internet. Whoever buys, they are the customer, I supply the product.

Selt.
When you buy the key, you also buy the box with the disc's, you just dont recieve them, you only recieve your key. In other words, EA/DICE and every other publisher/developer get their money since you actually did buy the whole package, so I HIGHLY doubt that they would waste time on something like this since it do them no harm at all, even if there is a written law that say you cant resell them. It's all about the cash for them and nothing else.

I think it's a great thing for us gamers (and most seem to agree on that), so keep it up internal_storm Smile

And we were right if they dont? Wink Smile
No one is questioning wether it's legal or not anymore, what I question is wether they care about this being illegal since they already got their money, and I highly doubt they do.
And like internal_storm said, the companies that did mail him did not bother to go any further after he mailed them back and explained how it works. Epic and ubisoft are not exactly small companies either Smile
So my theory about them not caring seem to be dead on.

sorry i told i wouldn't have aswered, but i forgot this last thing.
a battlefield 2 copy in u.s is sold for 50 dollars, in thailand is sold for less than 14, so ea obviously cares if everyone buys it from thailand or in the u.s.
i wanted just to say this. hope noone gets in trouble here, i don't buy and i can't do it for u also.

Pallebrun: You're missing the point.
Regardless of whether or not you're paying IS for a key that was purchased from IS, the key is NOT legal for sale outside of thailand. Is there some point of logic you just can't seem to grasp here?
yes money changed hands between EA and a seller, but that item that was purchased comes with restrictions.
He is violating those restrictions by selling them to individuals who live outside Thailand.
The sale is not legal. What he's doing is actually known as smuggling.
Noun

* S: (n) smuggling (secretly importing prohibited goods or goods on which duty is due)
The goods are prohibited from sale outside of thailand. He has smuggled them into other countries by doing what he's doing.
He theoretically could face prosecution for smuggling (which most countries do not take lightly) in any country a user has purchased the key in.

I clearly stated that I'm not questioning if this is legal or not anymore, it has been proven not to be legal, read my post better next time. All I'm questioning is, do EA or anyone else care? I dont think they do, at all.

I would like to know why you two care so much about this? You sound like a EB rep (or whatever company that sell games) that is mad because they wont sell as much copies as they would if keystore didn't exist Laughing
