I don't like jail time for drunk or reckless driving either. Fines are ok. They will pay for all sorts of good stuff! I really don't think jail will help anybody or make people better drivers or whatever it is supposed to do. I think zipfero has shown pretty clearly that we in Denmark do no like drunk driving in any way. People will be looked at as stupid fucks regardless of the punishment so no jail is necessary.

yeah thats pretty much what i thought. The difference and sample size seems marginal at best and is not enough to get to any such conclusions.
(btw i was only asking for source for the quoted part, not the rest)

You go to jail for drunk driving in most European countries. The difference is mainly an arbitrary percentage. I'm all for zero-tolerance. Getting into a 1.5-ton steel machine and driving in high speeds after drinking alcohol is like playing russian roulette with random people on the sidewalk.
Generally:
First time: 6-month suspension on drivers license and steep fines.
Second time: 12-month suspension and fines + self-financed alcohol-lock in car.
Third time: Life-time suspension of license and 2-6 months in jail.
If something happens while driving drunk, step #3. After that, give the dude a bicycle or send a plan and schedule for public transport.
Seriously, there's NO reason to get behind the wheel after drinking/drugging. Nobody has the right to take a risk with other peoples lives by driving while drunk.
People driving while drunk are despicable creatures that should be shunned from society like the vermin they are.

For those that defend zero tolerance, what's your opinion on using the phone while driving? And texting? Should it be punished with jail too?

Yes. Zero tolerance means exactly that; zero tolerance. If you get behind the wheel of a car and then knowingly, willingly, do something that poses a danger to those around you; yes you should be punished harshly. Your bullshit text message could easily cost someone their life, same goes for drinking. From where I'm sitting, the only ones bitching about zero tolerance are the ones with something to bitch about... there's simply no other reason to defend driving under the influence.
At the least, and I do mean very least, those caught driving under the influence or talking/texting on the phone should lose their license. None of this points bullshit, it should be gone instantly and you have to retake your test after an extended probation period.

Pretty much. I was really pissed when the traffic department said there was no use to forbid talking/texting while driving. Sweden is one of 3 countries in Europe that don't have a law against that. The liberals in the government sure managed to foul that one up.
Talking in the phone/texting means you must switch your focus from the road and the traffic as well as hundreds of small tactile, sensory, cognitive and calculating actions necessary to safely drive a vehicle on a road where there are other cars, bicycles, pedestrians etc..

Sending someone to jail for talking on the phone or driving after a couple of beers really seems stupid to me. Maybe with Scandinavian prisons it makes sense, but certainly not with the hell holes we have here. They don't educate anyone, jail only makes you come out far worse.
And I also don't get the "eliminate this scum (phone using/drunk drivers) from earth" kind of logic. Michael Schumacher once crashed his car in the back of a truck (on the autobahn if I'm not mistaken) 'cause he got distracted with the radio (or so he said). I mean, everyone does wrong things at the wheel (like driving with one hand only, talking to ms black who happened to be on the back seat, etc), everyone gets distracted sometimes... Surely there should be fines for a certain level of alcohol (like 0.2~0.8%), for cell phone or careless driving, etc. But suspension should be for bigger or repeated infractions (and drunk driving), while jail should be for crimes (mainly causing accidents, or being too drunk --like, if you can't drive normally anymore--, street racing, etc.).
There are studies showing that using the cellphone, even with hands free (BT), may be more dangerous than a low amount of alcohol. The thing is working people use cellphones, while alcohol itself is a villain.

Looks like this might have something to do with cultural difference. It might be different from country to country because roads/drivers/whatnot might be more dangerous in Brazil. As you say you guys have very high accident rate. Im not implying it, I just know that we got less drunk drivers here in Norway than in most other countries. I know that because we have a lot of police checkpoints checking drivers with breathalyzer. So why do 100-150 more people die on Danish roads? Its got to do with either alcohol or higher speedlimits. Its probably both.

Sorry for bumping up such an old thread but I was looking for this evidence and couldn’t find it. My uncle who works with a Los Angeles DUI attorney told me same and I think it’s something what we can call it a general perception among people.
