My turn to get get pissed around! Yay!

So I bought the KOTOR collection for PC, and a 3DS XL charging dock came instead (worth $20 more). Now I don't have any use for the dock, and I can't be arsed selling it, I just want the damn game.

Myself:

Hello

I had one item coming from England, yours, this game

Today I received a package with no return address, no receipt, with a nintendo 3ds charger inside, which could have only have been sent from you

Do you sell such items? Did someone else complain about getting a game?

Seller:
Quote:
Yes we do sell chargers and a large range of items.

We send invoices with all items - can you tell me what name is on the invoice inside? Also is there anything else inside, like a leaflet that might belong to us?

Myself:
Quote:
There's no invoice inside, just the Nintendo 3DS XL charger, it was wrapped in a silver plastic bag and it's from the UK. We have one item coming from the UK, and it was yours, you sell this exact item

Here is an image: http://######

This item is worth $18 more than what the game I ordered was, but I didn't order this, I don't own a 3DS and I just wanted the game

Seller:
Quote:
Hi,

Yes that picture looks like one of our items - I am very sorry about this. So far no one else has complained about receiving your game but they may not have received it yet.

I will arrange for the correct item to be sent to you. In the meantime could you please send this item back to us?

Please save the receipt of the postage cost and send us a photo so that we can refund you for this cost.

Once again I apologise for this mistake and I will be speaking to the processing team to see how this occurred.

Myself:
Quote:
Sure

Has the correct item been posted yet?

Thanks

Seller:
Quote:
Hi,

We will send out the correct item once the original item has been sent back to us.

Myself:
Quote:
So let me get this straight...

I buy an item, pay for it promptly, you send the item out, it took 10 days to get here, now I have to take time out of my work day to post it, I have to scan a receipt for you, I then have to wait another 10 days for it to get to you, then wait 10 days for the correct item to get back to me

...because you sent the wrong item?

I don't think so.

If I was at fault, sure, but not since you sent the incorrect item. I have no use for this whatsoever. When I receive the item I paid for, I will send you back your charger, not the other way around. I'd sooner leave negative feedback and be done with it.

Thanks.

Seller:
Quote:
As per ebay terms and conditions in the event of a mistake occurring the customer is in charge of sending back to the item to the seller so that we may send you the correct item.
The customer is also in charge of paying for the postage of sending back the item, however we have offered to pay for this - as you are correct, it is not your fault.

Please send back the item and let us know the tracking details. Once we can see it is on the way back to us, we will send you out your item.

As we still do not have any confirmation that you did not get that item from someone else and have also received our item - so we ask for this incorrect item to be sent back to us before a new item is issued. This is protect us from fraud.

Also please be aware it is against ebay rules to threaten with negative feedback to receive a refund when you still have an item with you.

Myself:
Quote:
You're quite right, it is against the rules to threaten negative feedback for a refund, but, I neither 1) Asked for a refund of any kind or 2) said that was the reason for why you will be receiving negative feedback. Please don't make things up. This is in the policy:

http://pages.ebay.com/help/policies/buyer-rules-overview.html

"This means you can't threaten to leave a seller negative Feedback if that seller won't do something that wasn’t promised in the original listing."

So was it promised in the original listing that I would be getting a Nintendo 3DS charger, or a Star Wars PC game? I would be well within my right to leave any type of feedback in that instance, though that's still not the reason I will be giving negative feedback regardless of the outcome. You'll be receiving negative feedback because the best case scenario for me now is to wait another ~20 days (in the least) to receive what I originally paid for. I still want the game. Not a refund. You made a mistake and now I am paying for it either way. This is why you will receive negative feedback.

Keep in mind you've already admitted it was your item and that you made the mistake in a previous message.

Also, the Australia Post website lists the cheapest postage option as $21.40 (sea mail) or $38.75 (air mail), one which is more than I paid for the game, the other being double what I paid. Feel free to check here:

http://auspost.com.au/apps/international-parcel.html

I'd be delighted to send it back. Cool Face

Thanks

The last issue I had was 2 weeks ago where I received a collectors edition that had dents all over it and I was required to pay the postage as it was a 'return', and not 'not as described' (even though it said BRAND NEW SEALED and not DENTED, SCUFFED AND TORN). Postage would have been $90 from here, I didn't send it back and eBay didn't rule in my favour.

Screw eBay's shitty policies and screw people who don't pay attention. If you're going to sell internationally, pack the fucking thing right and double check it.

That is why you don't do ebay, or not?

Edit: Sorry but my last ebay buy was in 2003 and then I also wondered what would arrive to me home. Too many crooks there, not worth it.

Never had problems it's great, NF really scares them Laughing

I remember a book once that I ordered that didn't came after 1 month, the seller sent another one that arrived soon thereafter, no charge of course. Then after 1 year I get the same book, was probably the first one that got lost in the mail somewhere.

Well it looks like they pretty much admitted liability in this message..

Now they're continuing to dispute the item is even theirs Laughing

I'll bet $20 eBay rules in their favour and I end up getting shafted. Again.

So are they saying the package you got was not from them, or that the contents wasn't and they did send you a game?

And what's with the buyer having to pay postage fees to send something back if an incorrect item has been sent out? That can't be right, can it?
