It wouldn't make sense for the store to sell returned items as used...that would just eat your profit margin. And you can't sell them as new since the seal has been broken.
Everything everyone tests and returns has to be sold eventually and in the end,it's profit that dictates how things go.

exactly. 14 days is such a bullshit. when i had noisy GPU i told the store about 14 days thing and they were like "but you opened it". no fucking shit, ofcourse i did, this is gpu, not a painting, i didn't buy it to stare at it. and how was i supposed to know if it has defect without using it. i don't know why computer hardware stores get preferential treatment and get except from normal returning like other stores. if i buy a lightbulb or a powertool i can return such items without questions asked and it takes 5 minutes to get your money back or exchanged to another item. but not for computer hardware, it's like they are above the law or something.
By law, the 14 days is indeed only for unopened products. Or technically speaking: you can return any goods without question as long as you didn't do anything with it you can't do in a real shop.
However, what you're describing isn't part of the cooldown period. That's warranty. A noisy cooler can be deemed defective. Under EU law you are entitled to the following:
If a product is defective or simply does not work as advertised they have to repair it, replace it, refund it or give you a price reduction on another product.
During the first 6 months after your purchase, burden of proof lies with them; if you say that it is defective, it's on them to prove otherwise. I wish them good luck proving that a noisy cooler is caused by anything other than it being shit. And given that all coolers come with advertisement that says "OMG SUPER QUIET", it's not hard to claim that it's bad advertising either.
During the 18 months after that 6 month period, burden of proof lies with you; you have to prove that the defect was caused by the product being bad. Again, not that hard; unless a cooler has been tampered with, if it suddenly becomes noisy, it's a piece of shit. This also means that if you manage to somehow fuck up your GPU by overclocking it to hell and back, you can actually replace it under warranty. They can't prove that you overclocked, so as long as you're not a fucking retard and tell them that you did, clearly the GPU must be broken since it just died on you. That's how I had my 8800 replaced not once, but twice. First time was within 6 months as well.
The above amounts to a total of 24 months (2 years) of minimum warranty that consumers get from shops (not manufacturers!) in the EU. Wherever the fuck you buy it from is also the place that has to take care of the warranty. They are not allowed to defer to the manufacturer. They are responsible for honouring these laws, not the manufacturer.
Here in EU, we have a 14 day 'change your mind' policy on anything bought via a webshop. So, I can 'change my mind' up to that period, for a FULL refund or replacement, no excuses

Interesting. The second card I ordered (the MSI variant) came with the box already opened, so that wasn't my problem. Also, a fully sealed CPU waterblock I received, and had fitted in my system, was returned on this 14 day warranty, without problems, and with a full refund received.

Pretty decent card for an AMD
Gained like 20 fps in AC: Unity over the 660, and the cooling is super efficient. 73 max temp and fan never goes over 50%, and I boosted it to GHZ edition clocks without meddling with anything extra.
EDIT: one weird thing though. When I had the gtx660, i set the game framerate to 58 in nvinspector.
And the framerate still holds at 58 with the AMD card for some reason.

You'll want this ARCTIC Acceleo Xtreme III 7970-cooler to get the absolutely most out of it (and make sure you use good 2-component TIM-glue for all the heat sinks for RAM, VRM's etc.), ie. 1200MHz+ GPU, 1700 MHz+ RAM (6.8GHz).
I only have a "lowly" 7950 which I haven't found a reason to upgrade yet but I've been getting the most out of it since the day I bought it and most games aren't an issue for me.
I've pushed it harder (1220/1700 (never bothered trying to get much beyond 1700 since the gain is nearly undetectable) but just as with my CPU I back it down from the extreme limits of 100% stable to a daily frequency to not stress the hardware too much.
3.5 years on and it's still going strong. Well, I haven't played a single game since Bioshock: Infinite was released so perhaps I'm not the guy to ask for advice regarding the latest heavy duty non-optimized stuff that has been released lately.
Seriously, at 1680x1050 you'll probably be fine with that 7970.
I went from a 7950 to a 290X and I went from "very much playable" to "yay > 60fps !" at 1920x1200.
I'd probably think about upgrading that little screen of yours first.

I still have a 22" 1680x1050 monitor and I'm not really looking for a new monitor at the moment. I guess if I'd really like to play on a big screen I'd simply get a HDMI-cable and connect it to my Panasonic Viera TX-47 AS750E 47" LED LCD-TV using the "Gaming"-setting to reduce latency.
If I go for a 27"+ monitor I'll go "wow" for a few weeks and then get used to it. Was the same with this one when my 19"-monitor died.
Besides, money is in short supply here and I have to prioritize. Since I don't play games these days (I will when Fallout 4 arrives) I see no point. I've spent my money on music equipment (new guitar, all-tube amp, multi-effect/amp-speaker-mic-sim/blabla Line6 HD300) and other stuff since I'm too busy playing in two bands and making/writing music for my main band.
Yes it depends. I went from a 1650x1050 Samsung LCD to an 1920x1200 Fujitsu IPS and imo it was a great choice. I dont feel like I need a bigger screen than that. I love the 16:10, but the main difference wasnt the resolution but the IPS that brought a huge bonus to quality.
I fear its going to be the last 16:10 screen I'll have so I'm sticking to it as long as possible.

16:10 is retarded aspect ratio. another abomination just like 5:4 was. in the past 16:10 1200p had "advantage" over 1080p because it had more pixels. but now with 1440p and 4K displays that argument is irrelevant and there isn't a single advantage to 16:10, only disadvantages with black bars in tv shows/movies and many games.

On the tests I read from computerbase.de the 280X is about 16% faster than the 380 and 18% faster than the 285 on average in 1080p @ high quality. I certainly depends on the game but I'd say that is a pretty clear difference. Sorry, the page is in German.
