The changes are part of the new Microsoft Terms of Services agreement that go into effect on May 1 and cover a plethora of Microsoft services.
There has been a significant amount of reports lately for both Microsoft and Sony for online cussing and slurs so I assume they updated the EULA to blanket cover all their services with some new terms although yeah going through stored data would be a bit of a privacy concern though at least they tell you about it here unlike other social and media sites and similar networks or apps and services.
EDIT: At least it's just a ban though, hell knows what they'd do if it's sexist or religious instead the way things are these days.
The comments on his blog indicate he's very much selectively reading the TOS based on how he "thinks the courts would interpret it" despite not actually being a lawyer because as someone pointed out, law student =/= lawyer.

With Microsoft saying that they're reducing their focus on single-player games and focusing more on multiplayer games with a long life (MTX and the likes), I could see them taking a closer look at their online community and trying to remove the cancerous players who drive customers away. That part, I don't care about.
Where it gets moronic is the idea that they want to moderate private conversations. Or the private content that we upload for ourselves exclusively. If they want to moderate public matches online and ban the people who think that the height of comedy is screaming "KILL YOURSELF" for 5 minutes uninterrupted, then go ahead. But conversations between friends on Skype isn't any of their business. Me uploading 17 pictures of my dick on onedrive isn't any of their business.
We are using Skype / Lync at work to communicate with VW and partners.
I wonder what will happen to your account, if you get banned during support insulting some assholes.

Sources close to Microsoft told Rectify Gaming that Microsoft has marketing rights to the following games:
Borderlands 3
Cyberpunk 2077
Splinter Cell
Battlefield V
Madden
Anthem
This is in addition to Shadow of the Tomb Raider and though unconfirmed, the rumored marketing rights to The Division 2.
Microsoft putting up a bit of a fight with Sony it seems.

Marketing apparently being that the media will align with the XBox One console so seeing it running on these devices (Or claim it's running on these devices...) and the X logo being shown for trailer videos and such stuff.
