If people knew that one day Epic would offer them an exclusivity deal and a mountain of cash, the campaign may never have taken off.
Is that any better or worse?
If people knew that there would be free aiming targeting in a turn based xcom-style game, the campaign may have not been as succesful.
If people knew the animations would be this clunky - 25 of them would not have funded.
If people knew that one day this alien tentacle would move in this particular way this one dude might have never backed it.
Where is the line? What I am saying is that they have full freedom to do whatever they want because this is literaly what they promised. YOU GIVE US THE MONEY AND WE DO WHATEVER WE WANT. This is what crowdfunding is.
The whole point of making the game for them initially is to make money. Not to appease backers or follow some everchanging moral guidelines that are different for everyone. What if they held a vote and it was 51 - 49 in favour of the Epic exclusivity deal? Would you have been ok with that? Just because they asked?
The thing is they could've released it without DRM for the backers and preorders at least. They distribute their alpha builds to the backers without any third party platform like Steam or GOG.

I wonder the effect it will have on people that have actually invested (through Fig by acquiring shares if this option was available; at least I think it was) in the long-term since this clearly may be considered as a case of loss of future earnings. Will they be able to sell back at same value the shares/inv.% bought or will they suffer a loss.
This may have considerable legal implications as well for them. They should have divulged all information before hand.

There has been, understandably, a lot of concerns about the Epic Games deal. So for sake of clarification I will explain what is involved for existing backers of Phoenix Point and what it means for the future.
Phoenix Point will be DRM free. The Epic store client does not require an ‘always on’ internet connection. This means that you can download the game and play it, even if you uninstall the Epic client. (You will need to use the client to update the game, however)

Can you sue a company that crowdfunded? With Kickstarter, I don't think you can. Not sure about this way as they didn't use Kickstarter. Things get changed all of the time during and after funding is complete. Look at the games that didn't deliver on their promises.

i think you can sue, but you can't gain much because of the refund policy; you could argue and sue them for the 1 month only refund timeframe, that is quite absurd right now... i should have the refund option until the very last of time, not months before release.
Apparently Shitshit Games or whatever their name is contacted Epic, not the other way around. Julian Trollop claims it was all in the interest of the backers, of course.
They also haven't even figured out how they're going to give their Chinese backers the game since Epic doesn't work in China. They really thought this thing through. Not at all just jumping on money wherever they can get it. First with M$ and now this.
Bodes well for the game that they're this desperate.
They also didn't tell the investors about the deal because they signed a NDA with Epic. Apparently they couldn't tell about it before that they would make such a move.

now comes the new wave of crowd funded games that will promise much but are secretly hoping to get epic to buy them out
then with that money they can just issue refunds because all their backers were good for was to get initial development done so they could pitch to epic

Yep but their strategy is "this will piss off our customers, then they really want the game so they will probably just install our store anyway..." frankly we've seen a lot worse and even users here defend some of the laughably terrible practices like we should be blessed and thankful for the likes of EA, Epic, IndyScam #3284.
This is a nice play by Epic and Tencent here, i'm wondering how Steam will respond i.e do they still to thier guns 30% because they've cornered the market? Or to they drop their 30% to a number where Epic just cannot compete.
i hope they drop the percentage to a number Epic just can't work with. 12%-8% have fun tencent.
