If it's not fake, I'm guessing there's a fear of lawsuits.
I'm guessing legal footwork of dissolved company, liability dissolved with it (other than class actions possibilities) new company opened with now defunct and available studio name.
Sort of (not correct terms but to get the idea):
Oh no no, you cannot sue us for damage. You want Fntastic LLC. We are Fntastic Inc you see. We took over the dead name, and got the rights to the game from the last owners.
Could just be me thinking what would a grifter do, but I think the wording 'is reopening' vs 'is staying open' has a purpose to be said that way.

- Studio closes down, with close to $3 million in the black on the books. With also some shuffling of it, like claiming $300k in 'travel expenses' for 2 guys as expenses already spent. (money bankruptcy cannot use as assets, as its claimed it's spent already)
- Steam tells them payments for sales do not go out until 30 days after date of purchases paid out to game company. And only 1/2 of sales are refunded (leaving $1.2 million on the table to collect).
- Studio announces it reopens (maybe under new company, with ownership of old IP's to get paid?).
Expect them to shut down again in 31 days
Either they are actually going to try to save this dumpster fire, or are the most incompently obvious swindlers ever. Like the looked up on wikipedia 'Most common fraud tactics'.

Fntastic is shutting down the game’s servers on January 22, 2024, following the closure of the company itself (which officially takes place today) and the supposed refund of every copy of the game sold thus far.

As much as a scam as it was, I can't fault them for anything in that video.
One clearly says "in game footage, work in progress" and the game was early access. Even a legit game can go "well..duh, its early access, not finished release. Of COURSE the features we announced was for the game, not early access" and be totally justified in it.
Now if it was released as final with no early access and it was that far off. Shit on them all day.
There is 101 things to shit this game for. Early release mechanics not being final release announced ones isnt one of them. (Sure they never planned to do them, but to say they was expected in EA, just like any game, is silly)

Shitting on something generates traffic based on drama.
So when these... hungry derp utub creAtorS smell blood, they annihilate without mercy or consideration.
I don't think this game deserved the overwhelming amount of poison it received. It's just another game with high goals and big expectations that went sideways (/fubar). So what?! It happens a lot in the industry. It's easy to stand aside with your thumb up your ass and shit on everything...
There's critique and there's huge amounts of vitriol for the sake of sensationalism.
Solution:
1. Don't preorder like a trucking moron.
2. Don't believe the hype.
3. Judge for yourself.
4. Vote with your wallet.
I'm not saying get hyped but I wonder how Once Human, a game in the same genre, that looks way more impressive than this, which has a playable alpha/beta as well, doesnt even have half or quarter the hype this game had. Kinda weird tbh.
In a shocking post on social media, the Fntastic team returned, stating that ‘everyone deserves a second chance’. They posted a link to a new game called ‘Escape Factory’ and stressed that they’re planning to fix their past mistakes. By ‘past mistakes’, they mean the swindling of thousands of gamers that left them a laughingstock of the gaming community.
Why don't these knuckleheads start a company with a completely different name?
at this stage i think its one of those "hold my beer" moves, like an inside bet by the owners, lets see how many people will get suckered in THIS time.
