Well I know in the states, They have this law that states once you buy something, its yours to do what you want with it. If you mod it, thats your right.. But Pirating games is illegal none the less. So, If you own the system, and have modded it, M$ can ban you from LIVE by their TOS, But they in no way can ban you from updating your system to play future games! I forgot the exact name of the law...

I think there is something up with the game TBH, i loaded it once and it did the opening videos fine - the next time it lagged like crazy, my xbox was not hot all other games work fine. MX just seems flakey, i hope it's the release.

Xbox Live ban updates
>> So we've gotten some interesting conclusions over the past week regarding the new 'waves' of bans over supposedly modified consoles on xbox live.
As you've all seen, Microsoft has started unbanning consoles. I've seen alot of people who were banned this past weekend, and are still banned, no matter how much yelling they do to poor customer reps. Others, who have modified firmwares ranging from 5.x to 1.4, and have never made a phone call have miraculously become unbanned!
As always with Microsoft, there is no rhyme or reason to their actions. A couple interesting things we have found...
You CAN have your console banned for having a 12v fan mod. A very trusted user of www.360patches.com got told directly from MS reps that his fan was modded on his 360 and that it violates the TOA. Any modification of hardware does indeed violate the TOA, so legally they reserve the right to ban users from live for that reason. Petty yes, but justified. A fan mod would be reasonably easy to detect, as voltage metering is something standard in all bios for the past 10 or so years.
In regards to 'bad game data' or kreon rips, SS, dmi and pfi, it appears that the reason MS might be unbanning xbox360's is because we've found evidence that strongly suggests ANY xbox360 can return bogus data. After some internal testing on a few older 360's, it seems that once a lens is near the end of its life, it can respond with all sorts of data, or lack thereof. A len's on the fritz was able to produce all sorts of odd angles that a new drive would not, aswell as tons of missing data throughout SS files (many chunks of data that read 00's instead).
So, it appears that MS is backtracking somewhat on the ban's, likely due to the reasons described above. Their infallible system has proven once again to not be perfect, and to attack innocent users. As always, we recommend that if you are a live user, to NOT modify your system, as you will eventually get banned.
Great i did a 12v fan mod due to the fact my 360 was overheating like a mofo, I had it RROD twice on the 5v standard fans. The sucker was working good, never imagined I would get banned for that!

Best way to do a fan mod it seems is to have it powered externally.
An old phone charger would be ideal to power a 12v 130mm fan.

I don't get it why people just don't buy a second console if they really care that much about Live, a Core isn't that expensive anymore. Instead people waste their time speculating about the bans, update firmwares, speculate some more, and finally get upset then the banhammer hits them.

Microsoft don't go into detail about mods I thought . So how did he get into a full blown conversation about being banned for his fan mod
Usually they fob you off with , you broke the terms and conditions and you fine well know what you did . Stop wasting my time k thnx bye

When your console gets banned does your gamertag get blacklisted as well or can you just buy a Core, connect your old hard disk and play on like nothing happened?

Updated today. Not banned yet, touch wood! downloaded the burnout demo, pretty good game tbh
I was banned in the Spring upgrade, this is my second box, currently running iextreme 1.2c. I have checked every game since my last ban with xdvdmulleter and binned (donated to nephew) all the ones that did not pass. fingers (and everything else) crossed.
No advertising.

I would assume its the lack of connection to the standard 5v fan header that is the problem. Not the source of the 12v line from the PSU. Anyway fuck em i dont care, rather have a working 360 than live access.

Dunno if I'm gonna leave it dorment but no point as I can't see a way it can detect firmware , Must be the rips
Staying clear of Halo though just to be on the safe side plus I think it's a bit wank

my 360 had survived the ban till now.but got a RROD. So i sent it to xbox360pros to get it fixed. They fixed it and send it back. I turned it on and connected to Live, and its banned. What a shitty luck.lol

just return it again! all 360 replacements are refurbished xbox'es. some of those are hit by recent ban hammers. just be honest and explain it to the customer help desk!
