I know that is why i'm going to start using it. Just trying to get facts from people that aren't banned. I know it almost seems random and some legit users get banned.

Had 3 consoles modded and none of them were ever banned. I get free xbox live gold cards so it wouldn't be a tragedy if I do get banned. I rarely play multiplayer. However, I do love the game updates!!!

Every time you send a broken xbox to MS repair center, they send you complimentary gold cards lol.

1. Sending it is free.
2. I have had mine fixed 3 times and it is still with a hitachi. Last time was just before GTA4 rel.

Which was in april ? liteons were discovered after gta was released
ms have flooded the market with them , in most cases replacing drives in repairs

How is banning performed (IF i get banned), will i be banned instantly when i turn on my xbox/insert my LAN-connection or does it usualy take a while? If it takes a while then at least i should be able to insert some games to get them updated or maybe at least get the dashboard update on the 19:th..

If you get banned it happens instantly,you wont see it coming,So if you still able to log in update your games now m8,Although you may get lucky if you not banned yet then you may get away with it this time?,But for how long?

I got 2 xboxs, none were banned on xbox live.. the first box I had was from 2006 and it has never been banned the other is from 2008. My friend went on live last night to play gears of war 2 on the 2006 360 which has never been banned from all the waves but last night it got banned straight away as soon as he started playing online with gears so I dont know if there are new checks on these disks or not.

you do not get banned for logging in, you got flagged for other reasons and then get banned at some point in time... you just discover that you have already been banned by logging in.
Just keep recent games out of your dvd drive to be on the safe side while online.

Should i remove save games (FO3 review copy / GoW2 etc) before i turn on my LAN connection to it u think, maybe it wont matter?

if that's so, what about people like my bud that has 2 360's, one modded and one that isn't and he never connects his modded box to live but uses the same hard drive between the 2. so he plays a copy on box A that is modded and is never connected to live, and then pops his hard drive onto box B that isn't modded and only plays retail copies online and connects to live to play with friends or download whatever, etc etc.

Thats exactly what I do. One for burns and one for originals + live.
So far, not been given a ban and thats through about 3 ban hammers. My suspicion is that either people aren't stealthing their games correctly (or relying on the groups) or MS are looking for something we not patching and don't know about (such as dvd firmware reads).
My advice would be to either get 2 consoles or stay well clear of live.
