If your Video memory usage: 100% it means there's a lot of paging in and out of texture data, causing performance loss. You want to keep Vidmem usage to just below 100% to make sure you avoid having the game constantly paging in/out texture data from System RAM/Paging file all the time. Change Texture quality to medium and increase View Distance instead. Minimal loss in texture quality, better performance and it will actually look slightly better with a higher View Distance.

yes your right if i tried low textures in the bench ten my fps go up with10 fps and the card is 80% loaded,
but in the game(sp) self it doesnt make any sens, the fps in the game stays the same

Birdymaster, are you sure? And ignore the bench, it's completely useless since it's rigged and won't show what kind of performance you will actually get in the game. I suspect that you may indeed get an increase in FPS but going from 15fps to 20fps is difficult to tell by eye alone. You need to run FRAPS or similar to measure the actual frame rates. I can't see that a simple patch will fix the performance issues most of us have with GTA4. I don't care about a 1-5fps increase, I want a 10-15fps increase at the very least, and that can't be done with a simple patch or an updated driver since the game itself is so inefficiently ported to the PC. Finally finished it. Awesome game form start to finish. But performance was ass. Like said earlier, memory leaks abound. I could play for an hour or more flawlessly at virtually any settings.. even far exceeding the recommended memory usage. But after a while it would start to chug and stutter, textures (mostly the road) would disappear or load very late. Setting it to low, auto or maxxed didn't matter. It still happened. Best way I found to solve it was to simply save and instantly reload when it got unbearable. This also serves as a free car repair too. I hope Lost and the Damned comes to PC and not just 360 only.
