I'd say you're running a completely unnecessary risk. Just for what? Having that latest (not-so-impressive) patch of a single game installed and working?
That laziness/stupidity might cost you several legit games (money spent, above all), and if they shut you down, you won't be able to do anything about it.

Well for some reason when I copy over the patch files and then start etw the game crashes after loading the initial load.... any way to fix this?

The reaction isn't always immediate. They can take action after a few days/weeks also.
The risk wasn't necessary from the first place.

made a mod to unlock the special units so editing the stock files isn't necessary

put to data folder and add "mod mod_unlock.pack;" to user.empire_script.txt - like normal mods

At present AI cannot perform naval invasions so pick a continental power like Austria, Russia, Ottomans..etc.
Or better wait for them to fix the game...

Use light version of the blood & smoke mod. It still looks great and the FPS is ok on decent systems/resolutions.
