Probably less safe than a confirmed disc but considering no one can confirm how MS are doing the bans then who knows. No backups are safe regardless of confrimation or not.
I'm personally not bothered about xbox live with one of my consoles therefore I'll be running on that.

yes it's normal !
you must connect to internet (just connect...) and you will see an update ! (Automatically)
make update and the game run fine after !

Well mine isn't telling me I need to update. It's plugged into the internet, but when I try and test internet connection it fails to connect to Xbox Live - it will show it's connected to the internet though.
I don't know what to do...
