I'm pretty sure that Kelly was involved. Infact, he co-wrote it.

Richard Kelly said the following about S. Darko.
"I have absolutely nothing to do with this project! I've been trying for a long time to prevent the producers from making this sequel that they made for money but there was nothing I could do. I haven't read the script, I haven't seen the trailer, I will never watch the film and I will never work with any of the actors or crew members involved in this. For me, this is pure betrayal. It is important that you write that I didn't have any control, absolutely none, over this story and that is just the product of mercantile guys. If I ever see it one night on television, I think I will make it explode (nervous chuckle). It's a horrible experience and I don't wish it to anybody who directed his first film."

I guess that this is wrong then. I checked imdb yesterday when I saw this film had been released to see if he had anything to do with it. To be perfectly honest, yesterday was the first that I had ever heard of it. I watched the trailer and it looks terrible. So I won't be watching it, that's for sure.

Eh that credit is ONLY because he created the original Donnie Darko movie and any characters re-used are of his imagining thus it would be illegal to not credit him without permission. Look at every single Marvel movie and it has Stan Lee as a contributing writer because he created the original character.
