This is the quote from Broussard that sums it up nicely (I'll take a big cup of "absolutely stupid and clueless" for 3DR):
| Quote: | | ""Either we're absolutely stupid and clueless, or we believe in what we are working on. In the end, you guys will judge the final results." |
And a couple of more hilarious quotes:
| Quote: | January 31, 2006: Interviewed by 1UP, Broussard is asked of DNF's progress, responding: "We're basically just pulling all the pieces together and making the game out of it. There's a lot that's finished. All the guns are finished. Most of the creatures are finished."
August 30, 2006: Shacknews reports that 3D Realms has seen several employee departures over the previous year. 3D Realms downplays the impact of the losses, asserting that work on DNF is still progressing. "Physics and animation systems are virtually finished and shippable," Broussard replies. "It's simply maintenance and polish from here on out." |
It's simply maintenance and polish from here on out.

The whole DNF debacle originates in the absolute inability of project management by Broussard. We're talking about an office where the devs drove to work in Ferrari's, Broussard showed more interest in the booth babes @ E3 than in promoting 3D Realms. He may be a good developer and game designer, but as far as project management and planning he's just a failure. That's the reason why DNF == Did Not Finish.

| Quote: | | umm, 3d realms has clearly stated t2 only HAS publishing rights after the game's released. IP belongs completely to 3D Realms |
It would still be a violation of publishing agreements, as far as I can tell.

Nope. The current "Apogee Software" was founded in 2008, as a spin-off of 3D Realms. They were and are totally separate entities:

Not to mention the fact that Scott Miller left 3D Realms after growing tired of sinking money into the never ending money wasting DNF project.

| Quote: | | The publisher also requested a copy of the existing Duke Nukem Forever source and object code "to ensure the code is preserved and remains unharmed during the pendency of this lawsuit." |
why would t2 be interested in the code, if they wouldn't hope to still release it? good news, i say!

Because it's part of the case, and i don't think Take 2 requested that, i'm pretty sure that's just standard for a case like that.
3DR hasn't cancelled DNF, and as such haven't broken any agreement(Atleast not according to the information we have), so my guess is that Take 2 needs to prove that the state of the game is far from being complete.
Obviously they seem to be shooting for the IP itself, by the time this case is over DNF will be history, atleast in it's current form.

even if they get just the IP, it would be better than letting it go to waste. maybe in another 10 yrs there's gonna be a real duke..

Take 2 previously offered to buy them out for $30mill and they refused. So they sued instead.
