Thing is, he's used the right word, in the wrong way.

Someone pays for a product.
It gets sent out early, through no fault or action of the customer's.
Since there was no wrong-doing on the part of the customer, and since they've paid for the product, they're entitled to use it.

I wasn't calling the poor sap whose console banned 'entitled' But infact the people who are making it such a huge issue... like it even affects their lives so much that they need to abuse/slander the shit out of a company which hasn't even screwed them directly.


That's why I hate neogaf with a passion, they seem to act all high handed in situations like this as if they were directly inconvenienced by Microsoft.

It *is* a huge issue, how can you not grasp that? It's a *massive* issue for a company to wield such power that they can ban your incredibly expensive system for doing NOTHING WRONG. It's a *massive* issue and people *need* to kick up a fuss about it, Microsoft shouldn't be "entitled" (chortle) to get away with practices like that. If Sony does the same thing to any early-acquirers for the PS4, then the same shitstorm will apply to them too.

I've never seen a "If a retailer breaks street date prematurely we may just ban you for his fuckup" clause in T&C's. What Microsoft should have done is deny him access because the system is not meant to be functional yet. Not ban him. He was not at fault, the retailer was.

What happens when you get a PC game before street date? It just won't activate. That's it. They won't block future activations or ban you from their shit.

He clearly wasn't authorized to release pics/media/info etc about the console before the street date, get it through your thick head, you own the console but you don't own their service if you break the ToS they have all the power to ban you.

Was it that hard for microsoft to add some simple time check to deny the guy access to the SO/dashboard/whatever?

Banning him instead is an incredibly moronic move. The ban can (and will) probably be reverted if the guy is still interested in the derpsole.

See and herein lies the reason why places like GAF should go apeshit over this. Does anyone really think Microsoft would reverse this ban if it was *just* this one guy? The hell they would. They'd leave him banned and regurgitate the ridiculous bullshit of "T&C! T&C! U broke them lolz" and that would be it.. $500 down the drain and guy is left with a banned system. BUT! If enormous places like GAF take the ball and run with, finally having the story being picked up by social networking and industry media outlets worldwide, it's a PR shitstorm for a company that has already had far too many PR shitstorms this year. They're more likely to reverse the ban on "release date" THEN than they are if it's just one poor bastard being caught and not having a pot to piss in.

The original xbox and how they handled that was a clear enough sign for me to stay away from their console division. And apart from exclusives I never understood people being positive about MS with their 360.

If history taught us one thing is that they seem to have a knack to always bet on the wrong horse. Maybe someday that will change but clearly not with this generation.

If it's gone to retail, then it's the final manufactured product. And it would had to have gone to retail to be sent out by Target. If this were a promo-box or dev-kit then I'd agree with you. But there is absolutely no way in hell that Target will have been sent something that isn't Final.

Now, you could argue that the firmware updates aren't final, and that by updating the machine he entered into an unauthorised Beta. But that's a stretch, since it's MS's code and update system, and if they weren't sure of the firmware at this point then they wouldn't have uploaded for others to download.

The guy was following the story, he knows it's a shipped product, sent to a customer early by Target, AND he's still calling that shit "most likely classified as a beta". So what you call "final manufactured product", that this guy and a bunch of other ppl are getting with their pre-orders, are just beta versions to Microsoft, the freaking company that MADE it. I want them to fail so bad. Not because I give a shit about ps4 or anything, it's just that ms artificially prevents these games from coming to pc. Pc has been treated like a step child for a long time, and I don't think MS will do anything about it. They just said they'll bring more games to pc just for good pr which they sorely need nowdays.

And I'm not a online console gamer, but I don't think you get banned for playing a street broken game?
